Terms of Service

1. Age Requirement

You must be at least 18 years old to use Lips Up. By using the app, you confirm that you are 18 or older. Lips Up is not intended for and may not be used by anyone under 18.

2. AI-Generated Content

All preview images produced by Lips Up are AI-generated visualizations. They are not photographs, not predictions of any real-world outcome, and not representations of how your lips will actually look after any procedure.

By using Lips Up, you acknowledge and agree that:

• All generated images are artistic AI interpretations for entertainment only.
• You will not present generated images as real photographs or as real outcomes of any cosmetic procedure.
• AI output may be inaccurate, unflattering, or unexpected despite our safety measures.
• You will not rely on Lips Up for any medical, cosmetic, or health decision.

3. No Medical Advice

Lips Up does not provide medical, cosmetic, or professional advice of any kind. Nothing in the app should be interpreted as a recommendation to undergo any procedure. Before considering any cosmetic or medical treatment, consult a licensed medical professional.

4. Acceptable Use

You agree not to use Lips Up to:

• Upload or process photos of any other person without their clear, informed consent.
• Upload photos of minors. Lips Up is 18+.
• Harass, defame, bully, or deceive any person using generated images.
• Present generated images as authentic photographs, before/after shots, or proof of any real procedure outcome.
• Attempt to bypass safety filters, reverse engineer the app, or extract data from our systems.
• Use the app in any unlawful manner.

We may suspend or terminate your access if you violate these terms, without notice or refund.

5. Your Photos and Content

You retain ownership of any photos you take or import into the app. By using Lips Up, you grant us a limited, non-exclusive license to process a cropped portion of your photo for the sole purpose of generating your visualization. See our Privacy Policy for a full description of how your photo is processed.

By submitting any photo to Lips Up, you represent that you are the subject of the photo or have the explicit permission of the subject to use it with the app.

6. Subscriptions

6.1 Payment Processing

Lips Up offers an auto-renewing weekly subscription. All purchases are processed by Apple through the App Store and are subject to Apple's terms and conditions. Payment is charged to your Apple ID at confirmation of purchase.

6.2 Auto-Renewal

Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

6.3 Managing & Cancelling Your Subscription

You can manage or cancel your subscription at any time by going to your Apple ID account settings (Settings → your name → Subscriptions on iOS). Cancellation will take effect at the end of the current billing period.

6.4 Refunds

Refund requests are handled by Apple in accordance with their refund policies. Lips Up does not process refunds directly.

7. Disclaimer of Warranties

Lips Up is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the app will be uninterrupted, secure, error-free, or that AI output will be accurate, appropriate, or suitable for any purpose. Use of Lips Up is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Lips Up, launchd, and their developers, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from AI-generated content, reliance on AI output, decisions about cosmetic procedures, loss of data, loss of profits, or interruption of service, regardless of the theory of liability.

In no event shall our total aggregate liability exceed the amount you have actually paid to Lips Up for the service in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Lips Up, launchd, and their developers, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the app; (b) your violation of these Terms; (c) your violation of any rights of any third party, including uploading a photo of someone else without consent; or (d) any content you submit through the app.

10. Intellectual Property

The Lips Up name, logo, and app are owned by launchd and protected by intellectual property laws. You may not copy, modify, or distribute any part of the app without our written permission.

11. Termination

We may suspend or terminate your access to Lips Up at any time, without prior notice, if we believe you have violated these Terms or are misusing the app. Upon termination, your right to use the app immediately ends.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Continued use of Lips Up after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. You and launchd agree that any dispute arising from these Terms or your use of Lips Up shall be brought exclusively in the competent courts of Tel Aviv-Yafo, Israel, and you consent to the personal jurisdiction of those courts.
