1. Use of Bella

You agree to use Bella only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the app in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the app or its systems.
• Use the app to transmit harmful, offensive, or objectionable content.
• Reverse engineer, decompile, or disassemble any part of the app.
• Use automated systems or software to extract data from the app.

2. User Content

You retain ownership of any content you create or upload using Bella. By using the app, you grant us a limited license to process your content solely for the purpose of providing our services.

Your content is processed locally on your device whenever possible. When cloud processing is required, your content is handled securely and is not stored after processing is complete.

3. AI-Powered Features & Data Sharing

When you use Bella's chat feature, your outfit photos and messages are sent to a third-party AI service (OpenAI) for style analysis. Photos are processed in real-time and are not stored by OpenAI. OpenAI's API data usage policy does not use API inputs for model training. By using Bella's chat features, you consent to this data processing. For more details, see our Privacy Policy.

4. Subscriptions and Purchases

4.1 Payment Processing

All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions.

4.2 Subscription Renewals

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription in your App Store account settings.

4.3 Refunds

Refund requests are handled by Apple in accordance with their refund policies.

5. AI-Generated Content

Bella uses artificial intelligence (provided by third-party AI services) to generate style feedback and outfit suggestions. All responses are generated automatically by AI and do not represent the views or opinions of Bella, its developers, or its affiliates.

AI-generated content may be inaccurate, incomplete, or inappropriate despite our safety measures. Bella is not responsible for any AI-generated content, including but not limited to style advice, outfit suggestions, or conversational responses.

By using Bella, you acknowledge and agree that:

• AI responses are for entertainment and informational purposes only
• AI responses do not constitute professional fashion, medical, legal, financial, or any other professional advice
• You will not rely on AI responses for any important decisions
• Bella implements content safety filters but cannot guarantee that all AI responses will be appropriate, accurate, or inoffensive
• Bella is not liable for any damages, claims, or losses arising from AI-generated content

6. User Conduct

You agree not to use Bella to:

• Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to manipulate, bypass, or override the AI's safety guidelines or content filters
• Use the service for any purpose other than personal style and fashion assistance
• Submit photos of minors, explicit content, or content depicting violence

Bella reserves the right to terminate access for users who violate these terms without notice or refund.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BELLA AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM AI-GENERATED CONTENT, LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL BELLA'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE ACTUALLY PAID TO BELLA FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Bella, its developers, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit through the service.

9. Intellectual Property

All content, features, and functionality of Bella, including but not limited to text, graphics, logos, and software, are owned by launchd and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Disclaimer of Warranties

Bella is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the app will be uninterrupted, secure, or error-free. Use of Bella is at your own risk.

11. General Limitation of Liability

To the fullest extent permitted by law, launchd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Bella. Our total liability shall not exceed the amount you paid for the app in the twelve months preceding the claim.

12. Termination

We may terminate or suspend your access to Bella at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the app will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the app or by updating this page. Your continued use of Bella after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
